Export Control Compliance Statement

1. Compliance with Export and Sanctions Laws

The customer acknowledges that Advantech products, software, technology, technical data, and services may be subject to applicable export control and sanctions laws, including but not limited to U.S. EAR, OFAC regulations, Taiwan laws, and other relevant jurisdictions.

2. Prohibited Destinations and Diversion

The customer shall not export, re-export, transfer, or provide controlled items to prohibited or restricted destinations, parties, or transactions. This may include, without limitation, Cuba, Iran, North Korea, Syria, Russia, Belarus, and certain sanctioned regions of Ukraine.

3. Restricted Parties and Screening

The customer confirms that they are not a restricted party and shall not provide controlled items to any restricted or denied party. The customer is responsible for conducting appropriate screening before transactions.

4. End-Use Restrictions

The customer shall not use controlled items for prohibited end uses, including nuclear, chemical, biological weapons, missile systems, restricted military use, or military-intelligence end use.

5. Licenses and Documentation

The customer is responsible for obtaining any required import/export licenses, permits, or approvals. Upon request, the customer shall provide accurate and complete information or documentation required for export compliance review.

6. Transaction Review

Advantech may request additional information, delay, suspend, or refuse transactions if required information is not provided or if there is a compliance risk.

7. Downstream Compliance

The customer is responsible for ensuring that any downstream transfer of controlled items complies with export and sanctions laws.

8. Recordkeeping

The customer shall maintain complete and accurate transaction and compliance records for at least five years or as required by applicable law.

9. Audit and Information Requests

Advantech may request relevant documentation to verify compliance. The customer shall cooperate and provide such information without undue delay.

10. Notification of Non-Compliance

The customer shall promptly notify Advantech of any actual or suspected violation related to controlled items.

11. Suspension and Termination

Advantech may suspend shipment or terminate the relevant transaction if the customer fails to comply with this statement.

12. Indemnification

The customer shall indemnify and hold Advantech harmless from any claims, liabilities, damages, fines, penalties, or expenses arising from non-compliance.
